The new Criminal Procedure Code of Georgia, which has been in force since October 2010, has introduced many legislative innovations in criminal procedure legislation. Among them, one of the novelties is the authorization of the principle of discretion in the modern Georgian criminal process. Under the new legislation, the principles of criminal prosecution are newly regulated, its commencement and implementation are at the sole discretion of the prosecutor. Upon the introduction of this new institution, the author published a paper in the form of a monograph on the prosecutor as a subject of criminal prosecution. Since then, new judgments and positions on the legal perfection of discretionary prosecution in Georgian procedural-legal science as one of the main procedural activities of the prosecutor have been recorded, some amendments have been made in the Criminal Procedure Code, in view of which the author decided to publish this paper on criminal prosecution as one of the important functions of the prosecutor.
