Description

Civil Procedure (Preliminaries to Litigations) is a book which provides for an account of the general principles of civil procedure and practices applicable in Mainland Tanzania in litigations. Mainland Tanzania has principle of laws which is mainly common-law based. Thus litigations follow adversarial system of procedure. The aim of this book is to state the law and practices followed by the Courts and explain it in as simple language as possible. The book does not cover the entire traditional topics in the subject. It has been written following closely the syllabus of Mzumbe University in the subject of Civil Procedure I for LL.B. But then it does not cover all the topics and so topics like Classification of laws, Hearing of suits and the Summons for the witnesses have not been included in this book. These topics, together with others, have been covered in the second part of this book, which is known as Civil Procedure (From Pleadings to Appealing), which was published in 2017.
