The onerous responsibility of Bangladesh judiciary is to establish the rule of law and upgrade citizens’ rights in the country. In discharging its responsibility, the higher judiciary-the Supreme Court of Bangladesh is empowered under Article 102 of the Constitution to protect citizens’ rights and examine the activities of the executive, legislature and even the activities of lower judiciary. On the contrary, aggrieved citizens of Bangladesh are generally entitled to move to the higher judiciary for the enforcement of fundamental rights and to the lower judiciary, for the enforcement of non- fundamental legal rights. In order to ensure citizens’ rights and establish the rule of law, the judiciary must be separate, independent and competent.
