Description

This study examines the human person, marriage, and the family as foundational pillars of law and society, grounded in human dignity. Persons, as subjects of rights and duties, are the starting point of legal systems. Marriage is not merely a contract but a social, ethical, and legal institution fostering stability, reciprocity, and the family. Families, in diverse forms, are the basic unit of society, requiring comprehensive protection and public support. The research focuses on the Roman law institution of curator ventris, a guardianship protecting the unborn in the absence of the pater familias, analyzing its classification into cura personae and cura bonorum and the guiding principle of dignitas. By integrating Roman, constitutional, and canon law perspectives, the study shows that protecting the person, marriage, and family is a universal legal, ethical, and civilizational imperative, essential for justice, social cohesion, and the common good.
